Effect of a Criminal Record Sealing or Expungement
Once your criminal arrest record is sealed or expunged, it is not accessible to the general public, employers or potential employers, or other inquiring persons. However, the Florida Department of Law Enforcement is authorized to disclose the existence of the sealed or expunged record if you are seeking employment, membership or licensure by any of the following:
- A criminal justice or law enforcement agency
- The Florida Bar
- The Department of Children and Families
- The Department of Juvenile Justice
- The Department of Education
- Any public or private school
- A contractor or licensee in a sensitive position having direct contact with children
- A local government agency that licenses child care facilities
The Right to Deny
You have the right to lawfully deny or fail to acknowledge the arrest covered by the sealed or expunged record, except when you are:
- Applying for employment with a criminal justice or law enforcement agency
- A defendant in a criminal prosecution
- A candidate for admission to The Florida Bar
- An applicant for employment, licensure or a contract with the Department of Children and Families or the Department of Juvenile Justice, or to be employed or used by such contractor or licensee in a sensitive position having direct contact with children, disabled or elderly persons
- An applicant for employment or licensure by the Office of Teacher Education, Certification, Staff Development and Professional Practices of the Department of Education, any district school board, or any local government entity that licenses child care facilities
- An applicant for employment by any public or private school
- Attempting to purchase a firearm from a licensed importer, licensed manufacturer, or licensed dealer, when subject to a criminal history background check under state or federal law
- Seeking authorization from a Florida seaport identified in F.S. 311.09 for employment within or access to one or more of such seaports pursuant to F.S. 311.12 or 311.125
